There are two agencies in the State of Washington where you file a discrimination claim: the Washington State Human Rights Commission (WSHRC) and the federal Equal Employment Opportunity Commission (EEOC). Both work collectively to handle your claim; however, the EEOC does not hear claims involving an employer with fewer than 15 employees. The WSHRC requires individuals to file a claim within six months of the date when the discrimination occurred, while the EEOC has a limit of 300 days. Once the claim is filed, the EEOC will either request that both parties enter a mediation program, investigate further, or dismiss the claim, at which point the individual is given a "notice of right to sue."

Your Legal Options

As discussed above, in order to pursue a federal case in court, you will first need to file a claim with the EEOC. However, the state does not require you to file with WSHRC in order to pursue a case. It is important to take note that the statute of limitations for filing a discrimination claim in state court is three years.
